Angela M. Adams, Law Office of Wm. Fletcher Belcher

Chapter 2019-71, Laws of Florida, was adopted this past legislative session.  This legislation provides that most electronic documents can be remotely notarized and/or witnessed when the notary, witnesses, and the signer (or “principal”) are in different physical locations and are connected via audio-video communication technology.  Of particular interest to estate and trust practitioners, the legislation includes provisions and rules allowing for wills, trusts, and other estate planning documents to be witnessed and/or notarized electronically, including when the witnesses and notary are not physically present with the testator/settlor/principal, but rather, are "present" via audio-video communication technology.  While the legislation includes a number of new provisions relating to notaries, this presentation will focus on the aspects of the new laws relating to electronic estate planning documents.

The breakfast roundtable meeting will be held at the St. Petersburg Yacht Club -  11 Central Ave, St. Petersburg, FL 33701. The meeting will begin promptly at 8 am with BREAKFAST and the opportunity to visit with SEPC members at 7:30 a.m.
